Day 242: Settlors

#QuickbiteCompliance day 242

### 🏦 Trusts: The Treasure Chests with a Secret Map… and How Pirates Hijack Them!

Imagine giving your treasure chest to a trusted friend (a “trustee”) with instructions to share it wisely. You might add a wish list (a “letter of wishes”) suggesting who gets what—like “save some for Timmy’s college fund!” But here’s the twist: the trustee isn’t legally bound to follow your wishes. This setup—where settlors transfer assets to trustees who have discretion—is called a discretionary trust.

While most trustees play fair, bad guys exploit this flexibility to hide dirty money. Here’s how:

### ⚠️ 3 Ways Criminals Abuse Discretionary Trusts

1. The “Ghost Beneficiary” Trick

  – A drug cartel sets up a trust, naming fake “grandchildren” as beneficiaries. The trustee (a crony) “distributes” funds to these ghosts—but really, the cash circles back to the cartel.

  – Red Flag: No ID checks for beneficiaries, or payments to high-risk countries .

2. Sneaky Sales & Self-Dealing

  – A corrupt trustee sells trust-owned property to their own shell company for $1. Later, they resell it at market value ($1M), pocketing the profit.

  – Red Flag: Assets sold suspiciously cheap to “unknown” buyers .

3. The Offshore Round Trip

  – Dirty cash is sent to a trust in a tax haven. The trustee “invests” it in a fake business back home—cleaning the money as “legitimate” profits.

  – Red Flag: No business purpose, rapid money loops .

### 🛡️ Fighting Back: Smarter Trust Safeguards

Discretionary trusts aren’t evil—but they need armor:

– Verify EVERYONE: Trustees, beneficiaries, even the settlor’s dog walker. Use AI tools to spot fake IDs .

– Track the “Wish List”: If trustees ignore the settlor’s letter 100% of the time, investigate .

– Audit Trail Tech: Blockchain-ledgers for asset sales? Yes, please!

> ⚖️ Fun Fact: In one case, a trustee went to jail for using trust funds to buy a yacht labeled “for beneficiary team-building” 😉 .
